Welcome to Emberstone Network, a gaming community that provides roleplay experiences across FiveM & other games ("services"). By access or using our Services, inlcuding servers, website, discord or other platforms you agree to be bound by these Terms Of Service ("ToS). If you do not agree with these terms, you must not use any of our services in any way.
Article 1: Acceptance Of Terms:
By participating in our community or using our Services, you acknowledge that you have read, understood, and agree to abide by these ToS, as well as any additional rules or guidelines posted on our platforms(e.g., server rules, discord rules). We reserve the right to update these ToS at any time, and continued use of the services constitutes acceptance of any changes.
Article 2: Eligibility:
- You must be at least 16 years old to use our Services. If you are under 18, you must have parental or guardian consent.
- You must remain in compliance with the terms of service of the games we host servers for, including FiveM, Minecraft, Rust and any others we choose to support, and their respective platforms (e.g., Rockstar Games, Cfx.re, Steam, etc.).
Article 3: User Conduct:
You agree to use our Services responsibly and respectfully. Prohibited behaviours include, but are not limited to:
- Cheating, hacking, exploiting, or using unauthorised modifications or scripts.
- Harassment, bullying, discrimination, or hate speech based on race, gender, religion, sexuality, or any other characteristic.
- Sharing or soliciting illegal content, including pirated software, copyrighted material, Escrow protected resources or intellectual property you do not have full rights to.
- Impersonating staff, other users, or any individual or entity.
- Spamming, trolling or engaging in disruptive behaviour.
- Distributing malicious software, links or files.
- Violating the terms of service of Cfx.re or any other games hosted by our community.
Violations may result in warnings, temporary bans, or permeant bans from our Services at our sole discretion.
Article 4: Account and Security:
- You are responsible for maintaining the security or your account(s) used to access our Services (e.g., Cfx.re account, Steam account, Discord account or CAD account.).
- Do not share your account credentials with anyone.
- We are not responsible for any loss or damage resulting from unauthorised access to your account due to failure to secure it.
- Discord or community roles or permissions will not be reinstated to any account(s) without proof of a secured account(s).
Article 5: Donations and Payments:
You agree to take full responsibility for your billing, banking and transaction details. Our provider ("Tebex") handles all payment information, we are not responsible for any issues or loss due to invalid billing details.
- Our community may offer donations options or paid perks (e.g., Cosmetic items, priority access). All payments are considered voluntary donations and are non-refundable unless required by law.
- Donators do not receive any exemptions from these ToS or any other rules.
- We reserve the right to modify, suspend or discontinue donation perks at any time.
Article 6: Intellectual Property:
- All content created by our community ("Emberstone Network"), including server configurations, custom scripts, mods, and other assets, is the property of our community ("Emberstone Network") or its licensors.
- Your may not copy, distribute or modify our content without express permissions.
- User-generated content (e.g., in-game creations, forums posts) remains your property, but by submitting it to our Services, you grant us a non-exclusive, royalty-free license to use, display, and distribute it in connection with our Services.
Article 7: Third-Party Services:
- Our Services may rely on third-party platforms, including FiveM, Discord, ImperialCAD. You must comply with their respective terms of service.
- We are not responsible for outages, bans or issues caused by third-party platforms.
Article 8: Termination:
- We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, including for violating these ToS or any other rules.
- You may terminate usage of our Services at any time.
Article 9: Disclaimer Of Warranties:
Our Services are provided “as is” without warranties of any kind, express or implied. We do not guarantee that our Services will be uninterrupted, error-free, ore secure. This includes, but not limited to outages, data loss, bugs, glitches, account suspension.
Article 10: Limitation Of Liability:
To the fullest extent permitted by law, Emberstone Network and its affiliates, staff, or partners shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of our Services, including but not limited to loss of data, account bans, or financial loss.
Article 11: Indemnification:
You agree to indemnify and hold Emberstone Network, its staff, and affiliates harmless from any claims, losses, or damages arising from your use of our Services or violation of these ToS.
Article 12: Governing Law:
These ToS shall be governed by the laws of the UK ("United Kingdom of Great Britain, Scotland & Northern Ireland") without regard to its conflict of law principles, Any disputes arising from these ToS shall be resolved in the courts of the UK ("United Kingdom of Great Britain, Scotland & Northern Ireland").

Article 14: Miscellaneous:
